The state of Massachusetts has a three year statute of limitation on personal
injury cases. This means that you have three years from the date of your
injury to file a claim or you may lose your right to compensation. If
your injury was caused by a government entity or worker the statute of
limitations changes to two years from the date of the accident. In certain
cases where an injury is not discovered at the time it occurred the statute
of limitations "clock" begins at the time of discovery, or the
date the injury should have reasonably been discovered.
Personal Injury Damages
There are two main types of damages that are available in a personal injury
case, each seeks to compensate for a different loss associated with suffering
an injury. These damages are called economic damages and non-economic
damages. Economic damages compensate for financial losses such as the
inability to work, loss of earning potential and medical expenses. Non-economic
damages compensate for more abstract losses such as pain and suffering
and mental anguish.
There is a third type of damages available in certain cases, called punitive
damage. Punitive damages are generally only awarded when the negligent
party knew their actions would cause harm but did so anyway, as such they
are not often awarded.
