Attorneys Michael Murphy and Dale Morgan from Morgan & Murphy just recently obtained a $1,875,000 settlement for a 76-year-old man who sustained serious injuries when he was struck by a car while crossing a street in Waltham, MA during the early morning hours. The insurance company originally denied the claim even though the plaintiff was a pedestrian. They alleged that the plaintiff darted out into the street, giving their driver no time to stop. We filed suit in Norfolk County Superior Court.
Our client suffered a mild traumatic brain injury, a de-gloving injury to the left hand and forearm, bilateral sacral fractures, fractures of the L1-L4 transverse process, left rib fractures, a large subdural hematoma above the left eye, a distal thumb fracture and soft tissue swelling of the forearm and hand with debris. His medical bills totaled approximately $1 million.
Morgan & Murphy engaged an accident reconstructionist to demonstrate through three-dimensional renderings that the plaintiff was already walking within the crosswalk before the defendant began his left turn. We also mediated this case and it settled after the second mediation. Prior to mediation, we conducted a focus group to gauge how a similar jury would react to the facts of the case. The results of the focus group were very supportive to the plaintiff and video clips were used during the mediation.

Morgan & Murphy was able to get our client’s own insurance company to pay the policy limit for pain and suffering under the uninsured motorist section of her policy.
